Is there a statute of limitations on personal injury claims from an auto accident?
I live in Wisconsin, if that matters.
Public Comments
- Ask your auto insurance agent. That is something he is paid to know.
- Yes. It varies from state to state, usually between 2 and 4 years. Your agent will know what it is for Wisconsin.
- Personal injury actions must be brought within three years of the date of the injury in Wisconsin.
- You have to settle or file suit within three years if you are collecting from the other drivers insurance. If you are making a claim to your own policy under the Uninsured/Underinsured Motorist Bodily Injury (UMBI) or coverage then under WI statute 893.43 you have six years.
