Accident claims. What companies will actually let you make a claim where NO injury is involved? What time limit applies to lodge personal injury claim accident 01/10/2000 in Qld injured person DOB 12/01/88? While riding dirt bike on private property my son hit a pile of rubbish, went airborne across road between this property and his place of residence and hit side of residence. He sustained multiple injuries - 10 days in Intensive Care and 5 weeks in Hospital. Date of accident was 01/10/2000. He was 12 at the time (dob 12/01/88). We were told at the time that he would not have a case for personal injury claim but current advice indicates he may. We have been given two conflicting opinions as to when a claim would need to be lodged. One opinion is 9 mths from when he turned 18. The other is 3 years from turning 18 ie 21 years of age.

Settlement Values for Injury Claims? Nearing the end of 4 years long of litigation over an industrial injury, my husband will be sitting down for a joint settlement meeting with his solicitor, a barrister and the defense team. The original schedule of losses prepared by my husband's legal team equated to over £300K but the defense have responded with schedule of losses quating to just over £20K. My husband's schedule of losses was adjusted to over £200K. The defense's schedule follows a medical report prepared by two orthopedic consultants - each representing either side of the claim. The gap between £20K and £200K is incredibly wide. Can anyone tell me how these meetings generally decide a final amount of payout? I'm so confused. Thank you in advance. No Damge to either of the cars involved, but woman claims injury.? While stopping (my speed was not registered) yesterday, I bumped into the back of the car in front of me. The women got out, was very rude, demanded my insurance, but did not offer hers, and neglected to call the police. Personally, I don't think there was any need as there was no damage to either car. She called my insurance company herself ( she did not contact her insurance company) and asked them what she should do with her bill (she is complaining of neck soreness). The company said she would have to file a claim before anyone got any money. My insurance company also asked her about the damages to the cars, and she said there was none. She has filed for injury, but I was told today that she filed no claim on her car, which makes sense because there is zero damage so she couldn't get any money that way. She was not that old, and not that frail so I highly doubt that my maybe 5 mph bump would jerk her head enough to cause any injury. What do you make of this situation? I should add that a family member was hit very hard from behind, has extensive damage on her fender and muffler but she was not injured. She is over forty, and was hit not once but twice. Car Accident; Back Injury Claims? I was in an accident about a month ago. I rear-ended some guy's car. He didnt want to call the police or the insurance company. How do you calculate how much a personal injury claim from a car accident should be? I was a passenger involved in an accident that was the other driver's fault. My arm was broken in an awkward place and my doc says it may not heal. He's ordered a bone growth stimulator to help the healing process but my care is far from being over. The doc also thinks I may have to go back to surgery in a year to remove the plates he put in. i'd be in a cast again for 6 weeks. Personal injury claim ? I have received a court claim form sent by claimant, I had a car accident last year. The claim form says: The claimant had been to solicitor, and got evidence from my insurance that i was at fault. She had suffered from minor knee injury, been to doctors and was on pain killers, took 2-3 weeks off work and has recovered. Expected value of claim is minimum £1000 limited to £5000. The papers dont specify how much exactly i have to pay although court fee is £108. (I have not been to citizens bureau yet) the options I have are defend part or whole claim, or admit whole liability or let court decide how much i should pay. In this case i have fill in a form and send them my income and expenses details. I pay £382 pm for loan repayments (1 yr left) , purchase credit £60 pm for 2 yrs . Own a car and additional expenses. Injury Claim Question !!!? I was involved in a car accident back in June 2007. I was at-fault. It was a really minor accident, that I hit the other's car at the side, like in 5mph, as I was stop at the exit of the gas station and tried to make a right turn. Personal Injury Claim and Settlement? I was in an accident 8/14 where a teenage driver rear ended me while I was stopped at a red light. The driver claimed her breaks hadn't been working. I suspect she was going between 10-20 mph. They hit the steel bar of my trailer hitch so there is no damage to my car, some damage to the front of hers. I suffered moderate soft tissue injuries and an injury to the C5 and C7 vertibrae in my neck. I have been seeing a chiro for five weeks and we have made some progress by my neck and shoulder are still painful and I'm unable to lift much of anything or do anything like yard work (i have a huge yard full of roses that need care!!) or even life boxes at my job. I am also having massage therapy as recomended by my chiro and general practitioner. I'm not about sticking it to the insurance company but I would like to know what is a "fair" amount so I'm not taken advantage of. I estimate my med bills to be about $1800 so far, treatment should continue for a few months. Thanks!! Injury claim? my wife had an accident at work and is on sick leave . She's just found out that due to the accident she requires an operation. We've also had to pay out for treatment, an MRI scan and to see a consultant privately. Her union reps are advising that she makes an injury claim, but she doesn't know what to do any help offered. Yes she did tell her employer and it was entered (eventually) into the accident book. (None available at the time). I was driving 40 mph and t-boned him because he came out of nowhere. My car was totaled. Well, my back hurt really bad and it was difficult to breathe. So, the next day I went to the doctor and took a chest x-ray (that came back fine) and had to get some prescriptions for the pain. I have finally received all of my bills, so I can move forward with my bodily injury claim. My medical expenses came out to about less than $70 because my health insurance covered most of it. I called the representative from the other driver's insurance company to ask what I should do next, and he said that I should mail the stuff in (which I will) and to include what I believe I should be awarded. He said I don't have to if I don't want to and they will just offer an ammount to me. I was in a lot of pain, but I don't know what to ask for. What do you think. I don't want to be greedy. I was terminated for refusing to change on the job injury claim!? I need orientation, I was terminated after 5 years of service to a company after reporting that I sustained a on the job injury. the company's insurance carrier rejected my injury claim after I presented substantial supporting medical documentation. the company was forcing me with changing my claim to personal so my health care provider could pick up the tab instead of the injury carrier. after refusing to change my claim the company fired me with the claim that I had violated the companys attendance policy because my injury was not excused by the insurance carrier. in my view, they tried to force me to commit insurance fraud by forcing me to change my claim form job injury to personal. How much higher will a personal injury claim settlement go then the initial offer.? I was in a car accident a year and a half ago and hurt my back. I have been treated since then to help resolve the issues to no luck. Recently i got an offer from the insurance company to settle this claim. It is a rather large sum of money, but considering the factors is still low. It is quite possible i may have this injury for the rest of my life and have been taking pain medication for it for the past year and a half. I am wondering if their is an amount over the initial offer that they usually go to without having to go to court. double, triple, anything like that. If anyone has any info that would be great. I just started a new job manufacturing lottery tickets and on the first day the HR lady that hired me realized that she had never had gotten me to fill out a application form before hiring me and wanted me to fill it out for my records. In 2004 I had shoulder tendonitis from being a dealer at a casino I was sent and treated at a rehabilitation clinic in Kelowna for two months by WCB I have been fine since and I continued working at that job for two years after the injury. I wrote it down on the application. Ten minutes before the end of my first day I was called to head office and told that they had a concern that I couldn't work here because of a past injury. I said I have been fine and wouldn't have taken the job if I couldn't do it and would report immediately if something did. They said had to discuss it and told me not to come in the next day til they did.

workers comp. denied.job claims to have radioed me to return to base 1 hr. prior to injury. does this matter? tree applicator. pesticides. injuried while working. fall. immediatly sort medical attention. nurse asked for jobs med. carrier. I called job and they would not give me the info. said I was not following company procedure. They say have injury or accident you should return to base immediatly.
